Will Contest
There are people out there who will come between you and the true intentions of a loved one. If this happens, I can help. I am experienced in contesting Wills and will fight for what should rightfully be yours.
There are three ways to contest a Will:
- if the Will is not properly signed by the person making the Will and the witnesses;
- if the person making the Will is not mentally competent at the time the Will is signed;
- or if somebody exercises undue influence over the person making the Will.
A presumption of undue influence arises in cases where the person who benefits from the Will has a confidential relationship with the person making the Will and is active in procuring the Will.
Undue influence can also occur in procuring other gifts such as deeds, bank accounts or personal property.
